After selecting the property to be acquired and agreeing on the price with the seller, a sales contract is signed between the buyer and the seller, which includes the sales price, payment and delivery conditions and the characteristics of the real estate.

Non-TRNC citizens are required to obtain a “Real Estate Purchase Permit” from the TRNC State in order to purchase real estate in Northern Cyprus. This procedure takes 3-6 months to complete.

Following the signing of the contract, the Stamp Fee of 0.5 percent of the Contract Price must be paid to the Tax Office within 21 days following the signing of the contract. Therefore, the contract becomes financially legitimate.

The Sales Contract must also be registered with the Land Registry Office within 21 days of signing.

The buyer registers the contract with the Land Registry Office stating that the real estate sold will in no way be at the disposal of third parties and the right of ownership becomes legal.

In addition, a photocopy of the stamped contract from the Tax Office is required.

Foreign nationals are allowed to acquire one house or one acre of land per person in Northern Cyprus. Married couples are treated as a single person.

The “Title Deed Transfer Fee” of the purchased real estate must be paid by the buyer. When a title deed is transferred, the North Cyprus Land Registry Office charges a Title Deed Transfer Fee. This rate is 6% for anyone who has previously benefited from the discount.

Value Added Tax (VAT) and Withholding Tax must also be paid. The buyer is obliged to pay 5% of the sale price of the real estate as VAT.

The seller is obliged to pay the withholding tax to the tax office. This rate is 3.5% for non-profit (owner-occupied) sellers and 4% for for-profit (contractor) sellers.

There are three types of real estate in Northern Cyprus;

TURKISH KOÇAN : This is the name given to houses, properties and workplaces owned by Turkish Cypriots or foreign nationals before 1974.

EQUIVALENT KOÇAN: In 1974, Turkish Cypriots who had to leave their homes in Southern Cyprus and settled in Northern Cyprus were given real estate equivalent to the houses they left on the Greek Cypriot side by the TRNC state in exchange for the houses they left in the Greek Cypriot side. Turkish Cypriots who bought “equivalent” real estate signed documents claiming that they gave up their land in the Greek Cypriot part of the island and received the title deed of their “equivalent” real estate from the TRNC state. Equivalent properties are considered safe and can be bought and sold in any form.

ALLOCATION TITLE DEEDS: These are real estate deeds given to TRNC citizens or those who migrated from Turkey after 1974 as a reward for the TRNC state’s military victory, allowing them to settle and live in the country. These title deeds are guaranteed by the TRNC government and their owners have full ownership of the real estate.
